Our terms and conditions

This English version is a convenience translation. Only the German version is legally binding.

These terms apply to all training courses, instruction sessions, safety instructions, examinations and inspections of work equipment provided by Bildungszentrum Logistik GmbH & Co KG (BZL for short), Rottfeld 7, 5020 Salzburg — regardless of whether registration is made via this website, in writing, by telephone or in person. Deviating agreements apply if we confirm them in writing. The customer's terms and conditions do not become part of the contract unless we expressly agree to them in writing.

Where these terms refer to consumers, this means persons to whom the Consumer Protection Act (KSchG) applies — that is, everyone who does not book the course for their business. The mandatory consumer protection provisions apply to them in any case, even if anything to the contrary should be stated here.

1. Registration and conclusion of the contract

Registrations are considered in the order in which they are received. The contract is concluded as soon as we confirm the registration. For a binding booking via this website, you receive the confirmation immediately by e-mail; the invoice follows no later than the next working day. A non-binding enquiry is not yet a registration — we will get back to you with a confirmation or an alternative date.

Requirements apply to some courses, such as a minimum age or sufficient knowledge of German. They are stated for each course and must be observed when registering.

2. Right of withdrawal for consumers when booking via the website

Consumers may withdraw from a contract concluded via this website within fourteen days without giving any reason (Austrian Distance and Off-Premises Contracts Act, Fern- und Auswärtsgeschäfte-Gesetz, FAGG). The period begins on the day the contract is concluded. To withdraw, a clear statement sent to office@bildungszentrum-logistik.at, by post to Rottfeld 7, 5020 Salzburg, or by telephone on +43 662 42 46 27 is sufficient. You may use the model form below for this purpose, but you are not required to.

If you withdraw in good time, we will refund all payments already made within fourteen days of receipt of your statement.

If the course begins within these fourteen days, we may only begin providing the service if you expressly request this. We obtain this request at the time of booking. If you withdraw thereafter, you must pay the proportion of the service provided up to that point. If the course has been provided in full at your request, the right of withdrawal no longer applies.

This statutory right of withdrawal does not apply to businesses; the cancellation terms under point 3 apply to them.

3. Cancellation terms

Irrespective of the statutory right of withdrawal under point 2, the following applies to the cancellation of a registration: up to fourteen days before the start of the course, free of charge, thereafter up to the third working day before the start of the course fifty per cent of the course fee, from the day of the course or in the event of non-attendance the full fee. The date of receipt by us is decisive; cancellation by e-mail is sufficient.

A substitute participant may be named at any time and free of charge, provided that they meet the participation requirements. This means that a cancellation can be avoided in almost all cases.

4. Cancellation and changes by BZL

If the minimum number of participants is not reached, a trainer is unavailable or other compelling reasons arise, we may cancel or reschedule a course. We will notify you as early as possible. In this case, we will refund any fees already paid in full. There are no further claims, in particular for reimbursement of travel or accommodation costs or for loss of earnings. We reserve the right to change start times, course days or the venue, insofar as such changes are reasonable.

5. Prices and payment

All prices stated are net, plus 20 % VAT (Umsatzsteuer); we state the total amount including VAT before the binding booking and in the booking confirmation. The price on the day of registration applies. The course fee includes the necessary documents and course notes, unless stated otherwise.

The invoice is payable upon receipt without deduction, unless otherwise agreed in writing. In the event of late payment, the statutory default interest applies to consumers, and 9.2 percentage points above the base interest rate to businesses. Reasonable reminder and collection costs necessary for the appropriate pursuit of legal claims must be reimbursed.

We issue licence cards, certificates and attestations after receipt of payment and send them to you thereafter. Reissuing a lost forklift or crane licence card costs € 30 plus VAT.

6. Course procedure, attendance and examination

One teaching unit usually lasts fifty minutes. Admission to the examination and the issue of a certificate require full attendance and compliance with the statutory requirements; for some courses, attendance of at least 75 per cent is sufficient where the regulations permit this. The pass mark for all training courses is eighty per cent. Anyone who does not pass may retake the examination by arrangement.

Participants must follow the instructions of the trainers and the safety regulations on the training grounds. The Austrian Road Traffic Regulations (Straßenverkehrsordnung) apply on all practice areas. Anyone who seriously disrupts the course or endangers safety may be excluded from the course; this does not cancel the fee.

7. Training and inspections at the customer's premises

If the training or inspection takes place at the customer's premises, the customer shall provide the necessary rooms, equipment and operating resources in a safe operating condition and ensure unobstructed access. We charge travel costs in accordance with the current price list. If an agreed date cannot be kept for reasons for which the customer is responsible, we charge for the time and travel expended in vain.

Vehicles and equipment brought along must be registered, insured and in a safe operating condition. Their use must be agreed with us in advance.

8. Courses at partner companies

We run some courses together with partner companies or refer participants to them. In this case, we will tell you where the course takes place. We may engage competent third parties to perform the contract; this does not change who your contractual partner is, provided we have confirmed the course to you.

9. Warranty and liability

Our inspections are carried out in accordance with the state of the art and the applicable regulations. They assess the condition of the work equipment at the time of the inspection and do not release the operator from their obligations regarding maintenance, servicing and recurring checks.

We are liable for intent and gross negligence. Liability for slight negligence is excluded; claims for personal injury and claims under the Austrian Product Liability Act (Produkthaftungsgesetz) remain unaffected. By providing the training, we confirm that we have trained and instructed the participant in accordance with the applicable regulations; we cannot accept responsibility for their subsequent conduct when operating equipment.

10. Copyright in materials

Course materials, presentations, learning videos and examination materials are protected by copyright and intended exclusively for the participants' own use. Reproduction, passing on and recordings of lessons or materials require our written consent.

11. Data protection

Which data we process and for what purpose is set out in our Privacy policy. We only send advertising to persons who have given us their separate and voluntary consent to this; such consent may be withdrawn at any time.

12. Final provisions

Austrian law applies, excluding its conflict-of-law rules. The place of performance is Salzburg. For disputes with businesses, the court with subject-matter jurisdiction in Salzburg has jurisdiction; for consumers, the statutory places of jurisdiction apply under § 14 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG). Should any provision be invalid, the remaining provisions shall remain valid; the invalid provision shall be replaced by a provision that comes closest to its purpose.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
